Audiorista is a service provided by Pubfront ApS ("Audiorista," "we," "us," or "our"). This Privacy Policy explains how we collect, use, process, and share your information when you:

  • Interact with our content distribution, apps, websites, and other properties (each, a “Customer Property”).

This Privacy Policy does not cover data collected by our customers (publishers) who use Audiorista’s platform on their Customer Properties. We encourage you to review their respective privacy policies for details on their data handling practices.

By accessing or using our Service, you agree to the collection and use of your information in accordance with this Privacy Policy. If you do not agree, please do not use the Service.

As a customer using Audiorista’s services, we process personal data on your behalf in accordance with our Data Processing Agreement (DPA). This means that when you use our platform to manage and distribute content, we may process personal data related to your customers or end-users under your instructions.

2. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in regulations, technology, or our business practices.

  • Significant updates will be communicated via:
    • Email notifications (if applicable).
    • A notice on our Site or within the Service.
  • The "Effective Date" at the top of this policy indicates when the latest version takes effect.

3. Information We Collect

Audiorista collects and processes personal data in different capacities:

1. As a Data Controller: We collect and process personal data from our direct business customers (publishers, platform users) when they register, use our services, or interact with our platform. This includes account details, payment information, and communication records.

2. As a Data Processor: We process personal data on behalf of our business customers when they use our platform to distribute content to end-users. This may include data such as IP addresses, device information, and interaction logs with content. In this case, our business customers are the Data Controllers, and Audiorista acts as the Data Processor under our DPA.

We do not control how our Business customers handle personal data collected from their end-users. Each business customer is responsible for providing their own privacy policy regarding how they collect and use such data.

3.1 Personal Data You Provide

We collect personal data that you provide directly when you:

  • Register for an account.
  • Contact us for support or inquiries.
  • Subscribe to emails or marketing communications.
  • Complete a transaction, including payments for subscriptions.

The types of Personal Data we collect include:

  • Basic identifiers (e.g., name, email address, phone number, company).
  • Account details (e.g., username, password, billing information).
  • Communication records (e.g., emails and support tickets).

3.2 Automatically Collected Information

When you interact with our Site or Services, we automatically collect:

  • Usage Data (e.g., session duration, pages viewed, referring sites).

3.3 Distinction of Data Types & Our Role as a Service Provider

Service Provider Role

Audiorista primarily functions as a service provider (or “processor”) on behalf of our publisher customers. This means we handle Personal Data, Usage Data, and Tracking Data under their instructions when you interact with audio content or other materials on their Customer Properties. Our customers remain responsible for their own data collection and usage practices; we encourage you to consult each publisher’s privacy policy for information on how they handle your data.

4. Legal Basis for Processing Personal Data

In compliance with GDPR and other data protection laws, we process data based on the following legal bases:

  • For business customers: Data processed on behalf of our customers is retained as long as the customer’s account is active or as otherwise stated in our DPA. Upon termination of the customer’s account, data will be deleted or returned in accordance with the DPA, unless otherwise required by law.
  • For end-users interacting with customer properties: We process and retain this data based on the instructions of our business customers, who determine their own retention periods.

If you are an end-user and wish to delete or access your data, please contact the relevant business customer (publisher) directly.

8. International Data Transfers

Audiorista operates globally. Your data may be transferred outside the EU to:

  • United States.
  • Other locations where our service providers operate.

To protect your data, we use Standard Contractual Clauses (SCCs) and other legal safeguards. Please see this overview of our Sub-processors.

9. User Rights Under GDPR & CCPA
